  • I-94 Question

    Hi All,
    I came to the US on H4(valid this oct 2009). Changed status to H1 in Nov 2007 and have been working since then. My latest I797 has a I 94 expiry in Sept 2013.

    Now I'm going to Indian on a vacation. Which I94 do I surrender.

    Both the old one(expiry in Oct 2009) and new(expiry in Sept 2013)
    or just the old one.

    Return all I-94 that you have. Otherwise proper exit records will not be registered against those I-94s that you retain with you.

      Thanks for you response.
      I'm also going for H1 stamping during my India visit.
      The latest I94 is on my latest I797 which I will take to the consulate for stamping.

      Just a little concerned if i should tear off & hand over the I94 from the I797 which I will take for stamping

      Is it ok to tear the I94 off the latest I797

        Hi OP,

        As mentioned before by Shervin - you have to return ALL I-94's to airlines authority before you depart US.
        Make sure that you return OLD + NEW I-94's to them even if they forget to take it. Its your rsponsibility.

        YES- You need to tear off the RIGHT MOST BOTTOM PART of I797 which is your I-94 and return it
        For Visa stamping - you just need the TOP MOST part (Original)
