  • Visa stamp vs I-94 expiration date

Hello. My current visa expires on September 24 this year. My I-94 expires on October 4th. This is my first 3 year with H-1B. Another 3 year extension will be filed but just confused which expiry date matters when it comes to LCA submission.

As far as I know, i-94 is about staying/re entering to U.S. Whereas visa stamp expiry date is the last day that I can work and get paid in the U.S. The gov gives H-1B holders 10 days of grace period after H1-B expires, which is exactly makes sense that my current H-1B visa stamp expires on September 24 and 10 days after that is October 4th, which is I-94 expiration date.Since the extension filing can be submitted 180 days (6 months) before H1-B expires, my plan is to file as soon as possible - which is March 28th or around that time https://omegle.onl/https://xender.vip/ .

However, my company lawyer says differently. He says since I-94 expires October 4th 2024, the earliest filing date opens up April 7th (180 days prior to Oct 4th).

I'm pretty confident visa stamp expiry date matters when it comes to LCA filing timing but I can't seem to find this rule written. Could someone please help me to find any law, rules that proves my point?

What exactly the opening window of H1-B extension date is set by? Visa Stamp expiration date or I-94 expiration date?

    Thanks a lot.
