  • H1B extension after 6 years with I-140 approval notice!!!

    Hi,

    My H1B (second H1B extension - 6 years) is going to expire on Nov-15, 2011. My I-140 got approved with my previous employer. Now I changed the employer recently and did a H1B transfer with new employer with I-140 approval from the previous employer. I thought, with I-140 approval notice, the USCIS will extend the H1B to 3 years. But I've got a new H1B extension with the expiry date of Nov-15, 2011. They didn't extend the H1B validity period..

    1) What might be the reason that USCIS didn't give 3 year extension with approved I-140?
    2) Can we ask USCIS about this?
    3) I talked to lawyer and they said, "We have been getting H-1Bs "cut short" by the USCIS due to projects ending prior to the end of the 3-year period. However, as we asserted that you are not being placed on a client project, we are not able to discern why they selected this date. We'll be reaching out to them to clarify why we were not granted the full three years."
    4) What can I do in this situation?
