    hi here is my situation -

    I filed my OPT extension last December and am still waiting to be approved (my first-year OPT expired on Feb 24). I got the H1B lottery this year and the lawyer is asking for my STEM I20 and new EAD card which would not be ready right away.

    Now my questions are -

    do you have to have a STEM extension I20 + EAD card for the application?

    if so can I delay the activation of the H1B just to get my extension approved?

    is there any deadline for the H1B material submission?

    since materials are going to be submitted to USCIS which is also the institution dealing w the STEM extension - won't they be aware of the situation?

    Hi! Don't worry, let's break this down:

    OPT Extension & H-1B:
    1. You don't necessarily need the approved OPT extension for H-1B filing, but the new EAD might be required (check with your lawyer).
    2. H-1B activation can be delayed (discuss with employer).
    3. There's usually a deadline for H-1B materials (lawyer will know).

    USCIS Awareness:

    USCIS might be aware, but having both applications with them doesn't guarantee extension approval before H-1B activation.

    Recommendation:
