    I applied for an H4 status extension for my wife and received the approval notice. Her current H4 status expires on July 30, 2024, but the new status (as per the approval notice) starts on September 5, 2024, leaving her status unclear from July 30 to September 5.

    It was a concurrent application along with my H1B extension, where I submitted all the documents. My extension is approved from September 5, 2024, and they have used the same starting date for my wife. However, her current status is only valid until July 30. They should have referred to her passport visa stamping document, which clearly indicates that her visa is valid until July 30, 2024. In I-539 applications, there is no provision to provide a starting date.

    I am wondering if we need to apply for a fresh I-539 application for the gap period from July 30, 2024, to September 5, 2024, or if it is a typographical error from USCIS that can be fixed. We have already raised a service request to fix the typographical error related to the starting date. We have around 40 days left and have also requested to speak with a Tier 2 agent at USCIS. It has been more than 10 days as we have not heard anything back from USCIS. We requested to speak with Tier 2 agent seeking suggestion on taking correct step. Tier 2 agent have not called us.

    In the worst-case scenario of not receiving any update on the service request,, if we apply for a fresh I-539 application for the gap period from July 30, 2024, to September 5, 2024, will that affect her approval notice valid post September 5, 2024.

    Please help us with your suggestion.
