  • L1B to H1B Transfer

    Hi,

Currently i am working for a us client in USA on L1B visa. Company A processed my L1B in 2009. I have been in US for 1 year.Current my project is going to end , mean time company B interested to process my H1B petition. I am planing to work for my current company(L1B) until Jan 30th. My questions are like.
    1. If my petition get approved by Jan 25th. Could i work for company A until Jan 30th. Can i request my company B to start my payroll from Feb 1st.
    2. If my petition approved will i get new I-94 date.

Will i have any issues if i go for visa stamping later.

Could any one please let me know the better process.

    >>> If the petition gets approved as a COS (The approval comes with a new I-94), then you should immediately start working for the H1B employer. Any employment with the L1 employer after the effective date of the H1B COS is illegal. Wile filing the petition, the employer can request the start date as of 1st Feb 2011. Also, you cannot work for the H1B employer until the COS gets approved.

    >>> If the petition is applied as a COS, then it will come with a new I-94.
