  • Current I-20 expire before H1B get activated

    I am working under F1 CPT (Curricular Practical Training) and my I-20 will expire in July 2011. My company is willing to sponsor me H1B this year which starts on April 1, 2011 and will get activated in October if USCIS approves.

    In May or June, I can get my I-20 extended till October 2011. Is there any risk on H1B application when they see my current I-20 expire in July 2011 (before H1B get activated)? Do I need to go out of the country?

    The CAP is still open. The employer doesn't need to wait untol April to file the H1B for you. They can file it now as a COS from F1. If you do that, that will solve all the issues that you have asked.
