  • H1B Visa holder staying in India for more than 60 days

Hello - you might have been reading through the news where 3 IT professionals were denied entry to US at Abu Dhabi port. They claimed that they stayed in India for more than 60 days while on H1B Visa and that became the reason for denial of entry. I wanted to clarify, is it the STAY that matters or WORK during the stay that matters? Let's say if I am not working during my entire 60 days time in India and taking full time off (my company has unlimited time off policy), can that also cause a problem at POE? I heard that it's the "work" component during that stay that might cause the trouble, meaning if you are working for your US employer for that long while in India, then it may cause trouble. That's why lots of big companies put a restriction of 2 weeks nowadays on remote working.

Any thoughts will be very helpful.
