  • H1B Extension validity dates issue.

    I have my current I 797 valid till APRIL 2011. I applied for H1B extension and got my new I 797 extended till from JAN 2011 to NOV 2013 only (less than 3 years and i already have validity till april 2011 then why they cut down 3 months and gave me from JAN 2011).

    according to me it should be valid from APRIL 2011 to APRIL 2014 (3 years ).

    Please let me know what can I do for this?

    Extension is not blindly given for 3 years. Extension is granted based on the project documentations provided by the employer (Like project duration). Maybe your employer requested the extension only till that date. If you have 3 more months left in your H1B 6 year term, then you are still allowed to file another extension 6 months prior to the extended petition expiry date.

      I given the project reference letter in which it is mentioned it is "Open ended project". Still I will confirm with employer.

      As per your reply If I have not complete 6 year H1B term , I can apply for extension prior to I797 expiry date, so for example let say I came in March 08 and I have extension till Nov 2013 then I have still 4 months left in 6 year
      H1 term , am I right ??

        >>> USCIS these days doesn't accept these open ended projects. Your employer will need to show proper work itinerary for the duration of extension that they are requesting. No project can go indefinetely.
