Help or Suggestion on H1B extension beyond 6 Years of Stay in USA

Hi All, Thanks for reading this thread and for your time to response. I have been USA for about 6 Years on H1B and my Max out period is ending on second Week of November 2025. I had filed extension in the First week of July 2025 and recently converted to Premium process since my max out date is closure. Today I got RFE and and waiting for the more details on the RFE and due date to respond to my RFE is Same as my Max out date (i.e. Second Week of November 2025). I have filed my PERM in First week of December 2024 which is less than 365 day and I am short of 3 week to eligible to get the one year extension. Let say we respond to the RFE on/before RFE due date of the and What would be my status after second week of November 2025 while I am waiting for the decision on H1B extension? Thanks

Hi,
You will be out of status beyond your max out period. Therefore, please plan for your status change or leave country.
Once your PERM and I-140 approved then you can file another H1B petition. Please try to leave before current H1B expiry. Please try to keep some days left on H1B. It will help you to file H1B CAP exempt petition once you receive I-140 approved.
