  • Help with tricky situation h1 transfer

I'm currently in the final stages of my job interview process and trying to avoid any travel right now. However, my wife (on an H4 visa) is planning to visit India for a family event.

I'm thinking of staying in the U.S. until my H1B transfer is complete from new job. From what I’ve heard, if the H1B transfer is initiated while you're outside the U.S., it will trigger $100K fees. So my plan is to wait, get the new job and I-797 approved, and then travel to India for stamping and bring my family back with me.

    My main question is:
Does this $100K fee also apply to H4 stamping?
Has anyone gone through a similar situation and can share their experience?

    Hi,

Answered for this question already. copying same answer for your review.

    Hi,
No. you will not come under $100k fees proclamation as yours is H1B transfer petition.

Does this $100K fee also apply to H4 stamping?
    Answer: Surely No.

    Thanks
