  • H1B visa is going to Expire

    Hi,

    I am Satish, and I have a H1B Visa got stammped in India on Feb 2009, due to some family/ecnomical conditions I haven't travelled to US yet.

    Now I am interested to travel to US and I have a few questions in this regard, Hope someone will help me in this.

    1. I want my visa to be renewed before I come to US ( With out travelling at all) , Is this possible ? If so, can you give some ideas how to proceed.

    2. If the above is not possible, Can I travel for a month and come back to India for visa renewal, will this help my visa to be renewed with out hassle.

    3. If I come to US and try for a job, What are the chances to get a job there now. ( My backgorund is " Oracle Apps DBA with 5years of experiance).

    When do you current petition and Visa expire?
    In general you may be asked to prove that the job still exists for you when you join so late. You will also need documentation from your employer that they have a project waiting for you.

      My Visa will expire on Aug 31st 2011, Also can you tell me can I try for extension from India itself without coming to US atleast once ?

        Yes. Extension from outside U.S is nothing but a new H1B petition under the current CAP.

          If you get a H1B visa once, what is the validity of your petition?

            You can find the validity of the petition in the petition itself. Visa has got nothing to do with the validity of the petition (Visa is issued based on the petition).

            H1B (+ L1) in total is for 6 years and only the time spend in H1B or L1 status counts towards the 6 years period.
