New H1 from L2

    Hello

    My wife has been on L2 visa and will be completing ~4 years in the US. If we file for a new H1 for 2012 for her, would that H1 be valid for whole 6 years or (6 - time spent on L2) which would be around 1.5 years?

    L2 does not count against 6 years.

      Thanks! Actually she has been working on EAD for close to 3+ years out of these 4 years in the US. I hope that should also not matter when evaluating the H1B duration. Can you please confirm?

        Can someone please confirm if the H1 duration of 6 years would be reduced if a person has worked on an EAD while being on L2 visa?

          Only the time spend in H1B + L1 status counts against the 6 year term.
