  • I-94 Expiring

    Hi,

I am currently on H1B visa. My visa expiration date is July-5, 2027 (Stamped on my Indian passport).
However, when I travelled internationally (India) last year, my current I-94 record expiration date updated to April-15, 2026 that is
same as my Indian passport expiration date. I just got my Indian passport renewed. My new passport expiration date is March-9, 2036.
    I have following questions:

    1) Will I be out of status after date April-15, 2026 once my current I-94 record gets expired?
    2) I am thinking to travel to Canada to get my I-94 record updated to same as my visa expiration date (July-5, 2027). I have Canadian visitor visa. But, is it safe to travel internationally on immigration point of view these days?
    3) My Green Card date of filing (DOF) may get current by next visa bulletin (May-2026). Is current I-94 record is required while filing I-485 form (Green Card/EAD)?

    1. Yes
    2. Yes
    3. Technically, people in employment-based categories can file AOS as long as they haven't been out of status or working illegally for more than 180 days since their most recent admission. However, you won't be able to work after your I-94 expires, so will your company still sponsor you for the green card if you are not working for them?

This is my personal opinion and is not to be construed as legal advice.
