HIB company is registered in a different state. Is that a problem?

  • HIB company is registered in a different state. Is that a problem?

    I have an employer who wants to sponsor me for an H1B visa. My employer's company is registered in another state than where the work is being done. I assume that my employer is doing this for tax purposes.

    Will the fact that the company is registered in one state but the office and work is being done in another be a problem and therefore my visa application denied? Or is this common?

    As long as the LCA is for the location where you will actually be working, it does not matter where they are incorporated.

      Thank you for your reply. Do you know if this situation is common among h1b sponsors - I mean companies registered in other states while they operate their business somewhere else. Could that fact alone raise a red flag when it is being determined if the visa will be granted.

      Also, does the company president have to be the sponsor or can it also be the vice president or or manager/supervisor who fills out all the h1b application documents?

        As long as you pay the taxes to the correct state that you reside in, it should be fine.
