i797 question

  • i797 question

    Guys,

    I am yet to decide on my travel to USA, but if I decide to go, I have a strange problem.

    I have a valid visa and valid i797 from company A (They said they would cancel it last year, not sure if they have done)

    I also have a valid i797 from another employer - company B, but company B i797 had some typo in company name so they got the new i797 with the typo fixed.

    If at all I decide to travel, I would go with company B with valid i797, the problem is, I have the original i797 (with company name misspelt) the changed one is with the employer and he has misplaced it some where, since its been 2 years!

    So is it okay for me to travel with the misspelt company name i797. Will there be a problem at POE asking for my amended i797? Please let me know.

    It is better to have the corrected approval notice with you.
    Also, since you seem to be traveling after a long time after petition was approved, you may be asked to prove that the job still exists for you and that the employer has project waiting for you if applicable.

          oh!!

          So should I ask my employer to request another copy from the USCIS? He was asking me to use the old (original) and the new ammended copy and there should not be any problem at the POE, since its just a matter of company name(1 spelling was missed at the end) which they could always double check with the company registration number blah blah etc.

          How long does it take to get one?

            When you said "copy", I thought you were taking about the photo copy of the approval notice. The original petition from USCIS and the amendment will work just fine.

              Sorry for the confusion.

              Yes, I have the scanned copy and I'll take the printed copy (not the original amended i797)

              So essentially I'll have

              1) Passport with valid visa
              2) Original i797 with the company name misspelt
              3) Copy of amended i797 (Not the original, printed from the scanned copy what I have. - a photo copy) - Original amended i797 has been misplaced by employer

                Original I-797 + the copy of the amendment petition should work just fine. But I wouldn't advise you to take even that little chance. If you have time and if you can get the original amendment petition, that will help.
