Is it legal to hire a H1B employee on W2-Hourly wages/salary?

If petition is filed as full-time, the employee must work at least 40 hours per week and get paid accordingly. For part-time, less than 40 is fine. Wages should be at least as per LCA.This is my opinion and not legal advice. -
But's it's legal to pay or keep an employee on W2-hourly payroll schedule as long as we are paying as per LCA salary? please reply...this is urgent.Comment
