  • H1-B Visa renewal

    Hi,

I am on my 8th year of H1 [my I-140 is approved and 485 is pending ].

My H1 is about to expire in another 6 months.

If I apply for another extension, will the new H1 dates be effective on or after the expiry of my current H1 till 3 years or will it be effective immediately?

The reason I am asking is, If I travel to India after I get my new H1, say in another 3 months, then will I get my visa for 3 years or just 3 months?

    Thanks,
    Ted

Filing an extension means that you are requesting USCIS to extend the H1B term beyond your existing petition's end date. So if your current H1B expires on May 31, then the extended petition will be effective from June 1st.

However, when you go for stamping, enter the new petition's information in DS160 and show both the petitions to the VO. That way, they can issue you a visa from current until the extended petition's expiry date (3 years and 3 months in your case).
Not a legal advice. Use of this information is strictly at your own risk.
