  • H4 Stamp without recent pay stubs

    All,

I am a valid H1-B visa holder. I came back to India in Sep-2010 due to some personal reason. Now I am going back in last week of Feb-2011. My wife & kids do not have H4 visa stamping so I want to apply H4 visa for them. I do have all the required documents apart from recent pay stubs. I do have pay stubs for Jun/Jul/Aug/Sep - 2010.

    So my query is --
-- Should I apply H4 for them while I am in India or should I travel back to US & get the new pay stub & then apply?

-- Will there be any problems during the interview if I apply now while I am in India.

    Please advise.
    Thanks in anticipation.

Paystubs for the time you are outside US are not required. Your wife can tell the consulate about leave without pay. She may however be asked for client letter or some such job availability document.
This is my opinion and not legal advice.
