  • H1B Visa Stamping in Canada

    Hi,

    My Employer filed the H1B petition in Aug 2010 from india and it got approved in Feb2011.
    But in Jan 2011, i have visited US on L2 Visa to accompany my wife here in US. Currently i am in US.

    My questions are ,

    1. IS it possible to go to H1B stamping in Canada for my approved H1B petition? or do i need to go back to india and get the H1 B Stamped? please clarify?

    2. if yes, can i ask my employer to arrange H1 visa stamping in canada with out go back to india?

    If this is your first time H1B stamping, then you need to go back to your home country to get it stamped. If this is not your first time H1B stamping, then you can go to Canada.



    Alternatively, your employer can file an H1B amendment to change the H1B approval from consular process to change of status. If the COS gets approved, then you can start working without having to get the visa stamped.
