  • L1 To H1

    I have a L1 from Company A.
    Company B applied for my H1b with a COS.

    Now I want to stay with Company A as they have offered me a good compensation after my resignation....

    How can I continue with Company A.

    I don't have the H1b Papers with me....
    Can I continue on my existing L1...? or should I go to india and return back on the same L1 so that I get a new I94..?

    Please help its urgent....

    Leave the country asap (Return all your I-94's when you leave) and return back on L1 visa to get back to L1 status. Any employment with the L1 employer in U.S is illegal until you do this.

      I will do that in a day or two but what if the new employer refuses to give the documents...?

      Is my L1B I94 No. same as the new one I receive ?

      How do i tackle this situation..?

      Also my wife and daughter left the country two days back and they submitted the L2 I94 while their departure..

      Please suggest so that I can leave in 2 -3 days time

        The I-94 number associated with the H1B should be same the latest I-94 that you have. They would have used the same number from the copy of the I-94 that you would have submitted to USCIS while filing the COS.

        When you re-enter you will get a new I-94 at the POE which will take precedence over all the other ones. Even though it is advisable to return all the I-94's when you leave the country, if you cannot get that from your employer then there is nothing much you could do at this short time. I think you are okay since you the I-94 numbers are the same and you will anyhow get a new one when you return.

          This is nice to hear that the I94 Numbers are the same...

          Now regarding my Green Card...
          This existing Company A for which I work on L1B has promised my GC..

          Now I have this 1 week period from
          March 03, 2011 till I leave US in 2 - 3 days time where I was illegal with company A on L1B visa...
          Do I need to contact the Department of Labor for this..?
          Will I face and issues / questions during my GC process so that I can be back on track with everything legal.....

                I don't think you can correct it now. As it was a matter of few days, I don't think it will have much impact.

                  Further to add to this my current company A is a very big company.
                  My manager spoke to the Immigration dep. and they said that I could continue without leaving USA as its the payroll when run for the first time all this takes effect.

                  Anyways I plan to go to india and come back for everything to be clean and get a new I94.

                    Green Card and L1 Visa

                    I am currently on a L1 Visa and my wife is on L2 Visa.
                    I plan to apply my Green Card in EB1 - C category in the next 2 -3 weeks..

                    Can I initiate a parallel L2-EAD for my wife..?

                    Are there any issues wrt respect to that..?

                    Please let me know...

                      They are totally independent processes. GC has got nothing to do with the L2 EAD. As long as you are in L1 status, L2 extension and EAD can be filed.

                        Should I initiate a separate EAD for her....
                        Is there any advantage in doing that..?
