  • H1B extension

    Hi,
My H1B is going to exipre in July 11 2011. I need to travel to India in April or 15 days. I will be back to US by May 1 2011. My question is:

    1. Can I file extension Once i come back. I still have 70 days for my expiry?
    2. Which is good at that momemnt Premium / Normal processig?
    3. Will i have to face any questions at Port of entry?

    Thanks in advance
    Lakshmi

    1. Yes. You need to be present in US in order to file for extension.
    2. Premium Processing is fast. The H1-B extension is taking longer upto six months now a days with normal processing.
    3. Yes. Be prepared to explain that your employer is going to file for extension after the H1-B expiry. There should not be a problem.

You can stay up to the time you receive decision on your extension (beyond the expiry of your current visa: July 11, 2011).

Make sure to get advice of your lawyer before traveling internationally.

        Good luck!
