Help: Regarding Expired and never used I129

I have approved I797 document (Petition for Nonimmigrant worker) which was valid from 10/01/07 to 09/24/2010. The petition was filed in 2007. However i never used it. As My husband is working in US on H1b visa, i am now looking for job in US.
1. Can you please let me know if this I797 can be used or not.
2. Does getting I797 means cap exemption for next 6 years. If so does it mean that any employer can file cap exempted H1 for me.

I would highly appreciate early response.

Another employer can file a cap-exempt petition for you until you spend 6 years in the US in H1 status.
