H4 Visa Process

Hi,

Please give your feedback on the following case. I would appreciate immediate response as it is really a critical condition

1. Primary applicant and his wife are working in IT sector
2. Primary applicant on H1B had started H4 visa processing for his wife. His wife was planning to take leave for 6 months and accompany primary applicant. He has received H4 interview date
3. However in the meantime, wife's orgaization initiated her L1B visa due to critical requirement in the project. She was not able to cancel H4 interview date and hence decided to go ahead with No-Show option for H4 interview. Hence she didn't appear for H4 interview
4. Unfortunately her L1B visa got rejected
5. She is planning to quit her job and accompany her husband in US by reapplying H4 again

Please advise if she can apply H4 immediately after L1 rejection. Would there be any issues in H4 visa interview.

L1 rejection will not have any impact on the H4 visa processing as long as the reason for rejection is not her (**** certificates etc). If she is trying to use the same HDFC receipt that she sed to book the H4 visa interview before (no show), then she will have to go to the nearby VFS office. I believe there is a 180 Rs fee to reactive that HDFC receipt. Talk to the VFS helpdesk for more details.

Thank you Shervin on your quick response. The reason for rejection is not **** certificate but related to speacialized skills. Please let me know if we can immediately reapply for H4 visa. Her L1B got rejected on 17th March 2011 and H4 No Show was on 14th Feb 2011. Appreciate your help.

Yes, she can apply for H4 immediately. Talk to VFS helpdesk about the "No Show". They can help you with reusing the old HDFC receipt.
