Passport expiring while in H4 extention!

Our visa's are in extention (My H1 and H4 for spouse & Son) and delayed due to RFE, and I expect further delays.

Our Visa's/I94 already expired on NOV 20 2010.

I am running into an issue now. My 5yr old son's passport expires on MAY 21 2011, which is hardly 2 months away. How can I get his passport renewed at the Indian consulate while his visa is still stuck in the extention process at USCIS?

Hope someone can help. I am clueless on this!

go to nearby Indian Passport office. And you will be getting the new passport on the same day or within 2-3 days if going in person. Otherwise by mail/post, it will take 3weeks to 7weeks.

And after getting it, ask your attorney to submit the new passport copy if possible.
