  • H1B Visa on the passport expired but valid I-94

    The H1B visa on my passport is EXPIRED 6 months ago but my I-94 is valid thru end of March 2012. I understand that I can get my visa stamped in my passport without leaving USA. Is this TRUE? If so, what is the minimum period I have to wait to get new H1B visa in my passport?

    U.S Visa stamping can be done only at a U.S consulate. You need to go out of the country to get the visa stamping done because there is no need for a U.S Consulate within U.S.

      I forgot to mention that, my employer is filing I-140 for GC processing. Is your answer still the same?

        GC process has nothing to do with the visa stamping.
