  • H1B tranfer while in India

    Hi All,
here is the case, I have my H1B petetion filed from company A and it is approved. Still I didn't go for the stamping. Then a company B is ready to transfer my H1B, is it possible ?
I am in India and never travelled to US and never worked for company A.
    Please give your accurate answers.
    Thanks.

Yes. Give company B a copy of the approval notice from Company A and they should be able to file a new petition under the same CAP.
Not a legal advice. Use of this information is strictly at your own risk.

I have mentioned very clearly in my previous reply that the employer will file a new petition under the same "CAP". Which means you are already CAP counted and you don't have to go through the quota again. Think of it more like a transfer.
