  • F1 (Expired) to H4 in Tijuana - Please help

    Hi,
    Here is my case.

    My wife has an expired F1 STUDENT VISA. The F1 expired June 2010. My company filed for my H1 in December 2010 and while filing for my H1B extension they filed her H4 too.
    I now have the approved I-797 with petition numbers for both me and my wife.

    I have scheduled an appointment at the US Consulate in Tijuana to get our VISAS stamped. The appointment is on the 26th of April 2011.

    Now I hear from some of my friends that Tijuana processes only extensions and not COS (Change of Status). My wife's case is technically a COS.

    I checked with my company lawyer who is in San Diego and she says that as long as my H1B is an extension they will process her H4.

    I am a bit confused. I have paid the necessary fees and booked my hotels in Tijuana.

    Can somebody please help me if they went through a situation like this?

    You can try, it may work. Be prepared to travel directly to home country if denied.
