H1 denied - re-applied
Hi,
My last working day in Company A was 12/10/2010.
I joined Company B on 12/13/2010. Company B had filed for my H1 transfer (regular process) and I had the receipt number before I joined B.
B upgraded to premium process in March 2011 and I got an RFE in 1 week. B replied to RFE - transfer was denied on 04/04. Stopped working from 04/05.
Denial reason was Client letter not provided and B's lawyer had copy pasted wrong client name :-(
Applied for a new transfer (PP) for same company B on 04/11. This time we provided the client letter and fixed all the issues mentioned in the denial letter.
Got the receipt number on 04/14. Started working back after I got the receipt
I am not sure whether Company A has revoked my H1. I had I-94 till 12/31/2011 from Company A.
Questions:
1) Technically I was out of status from 04/05 to 04/11 (6 days). Will this affect the decision for getting an approval?
2) What will happen if Company A has already revoked my H1?
3) Assuming Company A has cancelled my H1 on 12/10/2010 (my last day), will I still be considered to be illegally present in US (it's less than 180 days)
4) What are my options if I get denied again?
