  • H1B premium process delay

I got an RFE on my H1B which is under premium process. Its been more than 30 days that we replied for the RFE and still don't have any update.

Please advice me on how to approach USCIS to get an update ASAP.

Does the online status say RFE response received?
This is my opinion and not legal advice.

No, it is still showing the below message:

"On March 17, 2011, we mailed a notice requesting additional evidence or information in this case I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283."

But we replied back on March-25-2011.

Was it sent to the right address? Your employer should give them a call.

It was sent through fax. Our attorney contacted them and they were saying that my case was still with an immigration officer.

I was worried why they are taking more than 30 days for a premium process?
