    Hello Experts,
    I am in a situation here, & I am sure I am not the only one here.

    I got a job offer from company A first and since I desparately wanted a job I accepted it and signed all the documents and sent them to the employer & client. The Employer has already initiated the LCA and the Client has started the BG Check etc. There is a clause of $3000.00 payment in case I dont join after accepting the offer.

    Then I got another Job Offer which is better than company A.

    Questions:
    1) Can I decline offer from Company A and accept the one from Company B?
    2) What are the implications / consequences?
    3) Will I absolutely have to pay $3000 since I have already signed the documents and the Employer has filed LCA?
    4) I believe LCA filing is free and there is no cost associated to it?



    Please try to answer each question.

    Employment in U.S is at will basis. However, it is hard to comment without knowing what exactly you signed with your new employer. It is advisable that you consult a lawyer to go through the implications.
