Question about H4 Visa renewal

I am on H1B visa since 2008 and i got the approval for extension very recently. My husband is on H4 visa and he needs to extend his H4 based on my visa. His I-94 expires by May 31st. Can we just apply 539 form with my 797 (H1B)? Can i get some suggestions for this please? How long it's gonn'a take to get his visa renewed? We are planning to India by October. Are we in safe situation?

Visa and petition are two different things. Visa is something that you get stamped in a consulate outside U.S. I think you are taking about extending the status of your husband's H4 inside U.S.

You have to submit form I-539 to extend the status of the H4 holder. The application for extending the status should reach USCIS before the I-94 expires. Today is 18th May and you don;t have much time. So act fast.
