    Hello,

    My L1B visa got refused in Mar.2011 Reason - Not clearly approvable.
    and B1 in lieu of H1 visa got refused in Apr.2011 Reason - 214(b)

    Could anyone please guide me on how it will impact on my H1B application for Oct.2011?
    Should i go for the H1B visa this year or should i wait for next year?


    My H1B sponsor is a large (28000+ headcount) Telecom IT service provider in India.

    Petition filed by your employer should not get affected.
    After petition approval when you apply for the Visa at a consulate, you must mention previous denials in your DS 160 form. It will not affect your visa application but you may be asked about these previous denials.

      Thanks a ton for your reply.

      Yes I would be defiantly mentioning about my previous denials in the DS160.

      However, after that
      1) Are there any chances of getting a H1B visa refused?
      2) If this (3rd time) happens will i be getting US visa in future?
      3) Would applying H1B visa in premium segment make difference?
      4) Should I go for H1B this year? (Considering previous two denials)

        1) Are there any chances of getting a H1B visa refused?
        >>> No one can predict if your will get the H1B stamped successfully or not. However, the rejection of the previous visa will not impact the new one as long as the reason for rejection is not you (Example: forged documents etc).

        2) If this (3rd time) happens will i be getting US visa in future?
        >>> Why not?

        3) Would applying H1B visa in premium segment make difference?
        >>> Only petitions can be filed in premium and not visa. Filing a petition in premium process or normal process will make no difference in your visa interview. You need a valid petition to schedule a H1B visa interview. Filing the petition in premium will get you the result within 15 days.

        4) Should I go for H1B this year? (Considering previous two denials)
        >>> Why not?
