  • H1-B stamping in Mumbai

My 6th year on H1B expires in Nov'11. My LCA has been approved and I-140 applied about 3-4 months ago but not approved yet.
I am traveling to India with family for vacation and work purpose and need to get visa stamped in Mumbai. I am guessing it is same as applying for a new visa , ie, I need to go through visa interview.
    My questions are:
    1) Is it a problem if I am travelling to India with my current H1-B expiry so near and I-140 not approved yet. Or is it safer to get my visa stamped in Mexico or Canada?
    2) Does my wife also needs to have her visa stamped?

    Thanks in advance.

    >>> Mumbai consulate is closed for renovation and no more H1B or L1 visa slots issued at Mumbai. You need to book the appointment in any other consulate.

    >>> Not an issue. As long as you have a valid extended petition, you can applying for visa stamping.

    2) Does my wife also needs to have her visa stamped?
    >>> If she want to return back as a dependent and if she won't have a valid H4 visa stamped in her passport by the time she returns, then YES. Otherwise, she can use the existing valid H4 visa and your latest petition to return back.
Not a legal advice. Use of this information is strictly at your own risk.
