    Hi,

    I was there in US on H1 until recently and came back to my home country after getting three year H1 extension. I attended H1 stamping interview and got a query for client letter.

    I have few issues regarding my case as below.

    1. My employer is trying to get the client letter through prime vendor from client company. Client company only issues the letter by mentioning 'prime vendor as my employer and not my actual employer'.

    If i submit that letter to Consulate for H1 query response, will there be any negative impact on my H1 and for future H1 trails?


    2. My employer is not good and i want to stay back in my home country for good. My employer ate all the money and often saying that he paid for my H1 extension fees and attorney fees for H1 query response. But he do not know my intensions as of now.

    How should i come out of this company safely with out issues and stay back in my home country? Please advice me ASAP.

    >>> Check if the client can issue you a letter without mentioning the prime vendor as your employer. There are chances that the visa could get denied under the fact that your employer does have control over your work at the client location.

    >>> Employment in U.S is at will basis. No one can force you to work for them if you are not interested. You can stay back in your home country if you are not interested in returning back to work for the employer. There isn't anything special that you need to do.
