    Hello,

    I am having a peculiar case, which I want to get it clarified.
    Actually, my current employer has got approval for my petition in Oct'2010. and he has provided the I-797 to me, this visa is approved for 3 years and it has not been stamped.
    In January 2011, I got a call from one of the US company for job offer and they said that they will apply for my H1B. So, they filed a fresh LCA and got it approved for 1 year. And in April 2011 from New Delhi i got that visa stamped on my passport till march 2012. But due to some reason I didn't join that company.
    Now, the case is that my current employer has asked me to take visa stamping from Kolkata and they have already taken the dates. They didn't knew about the other visa.
    Can anyone of you please let me know what will happen if I went for the stamping for this visa. Will it pose any problems. Or they will cancel that visa from US company and stamp the visa from current company, or both.

    Why do u want to go for H1B stamping again when its valid till 2012?

      No issues. They will cancel the previous one and will stamped the new one. However, since you already have a valid H1B visa in the passport, you can use that to travel. You have to carry the the approval notice of the employer for whom you will be working in U.S. The I-94 will be issued based on that petition expiry date.

        Thanks for the replies. Actually the one which is stamped is from US company for whom I have terminated the offer.
        And second one is from my current employer. which is valid till July'2013. And they have one position for me so wanted me to go for stamping.

          The employee name in the visa doesn't matter. Visa is just an entry document to U.S. You can still use the existing valid visa from the previous employer with the approval notice from the new employer to enter U.S. Read the FAQ section in immihelp
