  • H1 Transfer after 6 yrs

    Hi,

    I am on the 7th year of my H1 and I am eligible for 3 yrs extn (i-140 approval). My current visa is valid till March '13. I want to know is it possible for me to transfer to another company if I get a job offer.

    The questions I have are:
    What will be the validity of my visa, if the new CO sponsors up the H1-B?
    After I transfer, what will happen if the CO cancels my current H1-B?

    I basically want to get out of this EB-3 rut.

    If you have a copy of your I-140, then you can transfer your H1B to another employer based on the approved I-140 with the current employer. However, the GC process need to be restarted again. The current priority date can be recaptured.
