H4 filed not appr. - H1 amendment filed

Hello all -

Need your help immediately

My wife has filed for COS to H4 in Mar 2011
The application has not been approved yet and probably going to be 2 months before approval
My H1B needs to be amended as my job is changing to different city

Does anybody have any experience similar to this. Does the employer need to wait for the H4 to be approved before filing for H1 amendment?

Employer should file immediately. Your wife can send a letter quoting both receipt numbers to USCIS.

I asked USCIS the same question and they had the same answer. So for people in the same boat

- There is no need to wait for the approval of H4
- Just send the receipt numbers to USCIS (respective processing center)
