  • Stay in US after termination from Employer

    Hi,

I am with a big MNC on H1 in US. At present I am on bench for the last 2 months and in case if this MNC terminates my employment, how long I can stay in US before I get my new job.
Is there a grace period for moving from one employer to another or I need to leave unless H1 transfer gets initiated on or before my last date with the current employer?

    Please help.

    Thanks,
    TRV

First of all there is no concept of bench when you are in H1B status. If your don't have pay slips on H1B status (It should match your approved LCA), then you are considered out of status on H1B. There is no grace period after the termination. For your H1B transfer to be successful, your should file the transfer with the latest pay slips. If not, the transfer might get denied.
Not a legal advice. Use of this information is strictly at your own risk.
