Urgent for H1b, status (212(a)(7)(A)(i)(1)
Hi,
My friend got a H1B job offer.
But his status is (212(a)(7)(A)(i)(1) – inadmissibility.
The reason he visit US one year ago and the INS misunderstand him as his intention is job search and send him back from port of entry at US. And write this status on his passport.
How he can apply for H1B?
I came to know the INA 212(D)(3) NONIMMIGRANT WAIVER- available to allows applicants for admission as non-immigrants to overcome almost any ground of inadmissibility found in Section 212(a) of the Act.
So how to apply the waiver?
Is it employer apply 212(d)(3) waiver with H1B petition? Or
Is the employ apply the 212(d)(3) waiver in the embassy when he going for H1B interview?
Or, is any other solution?
Need your helpful answer as soon as possible.
