  • H4 option in case H1 stamping gets denied

    Friends,

    My H1b is valid till 12/2012. I am planning to travel to India in 11/2011. I have to appear for my H1b stamping.

    My question is - got forbid, if my H1b stamping doesn't go thru, am I eligible to apply for H4? (my wife's H1b is valid till the year 2013).
    If yes, what should be an ideal time gap?
    Would I face a difficult H4 interview in the given scenario?
    Is it a common scenario? I mean, do people opt for such backup plans?

    P.S - I initially came to U.S on H4 and then got my H1b approved.

    I would like to appear in Delhi consulate. Any feedback about this consulate would be highly appreciated.

    >>> Not as long as your wife's H1B documents are in order and if she is (or was) maintaining her valid H1B status.
