  • H1 Validity Period

    Hi,

I got my visa stamped in Mar 2007 and my first entry period in US was 25 Aug 2007 to 14 Dec 2008, second entry period was 18 mar 2009 to 23 nov 2010 and the last period is 2 jan 2011 till date. Both my I 94 and Visa expires sep 2012.

As per my initial H1 filing I 797 period is Oct 1, 2006 to Oct 1, 2009 and first extension is Oct 1, 2009 to sep 2012.

Please let me know by when I should start my GC filing and how long can I stay without GC.

    Thanks
    Kumar

Your total term on a h1B is 6 years. Only the time spend in U.s in h1B (+ L1) status counts towards the 6 year limit. GC should be filed 365 days before the end of the 6th year to get the 7th year extension. You do the math.
