When my wife appear for h4 visa?

Hi This is Ravi !!

My H1 is under Process On a Regular Basis. Its been filed On 12th July,2011.

My Question is, Once my H1 will get approve, when my wife should appear for H4 ?

Is your wife currently in U.S or outside U.S? If she is outside U.S, will she have a valid H4 stamped in her passport (as of the date of return) ?

She is In India Right now

My wife is in India right now. And she does not have H4 Stamped. My Extended OPT got over on 25th Of July,2011.
So, Right now My OPT Got extended as My H1 is Under Process.

Your wife can apply for her Visa anytime after the petition approval assuming this is not a new petition and you already have H1 Visa or you already are working in the US. If both of you are outside the US needing a Visa, both should apply together or wife should apply after you.

What do you mean by New Petition? This is for the first time i am applying for H1.
Before i was on My Extended OPT of 29 Months. I got job in January 2011.

Once your petition is approved with change of status, your spouse can apply for H4 Visa.

She can apply for the H4 visa anytime after your petition becomes effective. She doesn't need to wait until the petition effective date to attend the visa interview. However, she cannot travel before the petition becomes effective. She can travel only after Oct 1st.
