  • H1B Amendment

    Hi,

    I am having H1B visa which expires on nov 2013. And my current role is computer programmer, working in baltimore location. Now i need to change my role and location. So, Employer is filing H1B amendment.

    1. Will i loose my current status if my H1B amendment got rejected?
    2. i will be getting new I 129 petition and I 797 form. Should i need to appear visa interview in my home country if i leave US country.

    Please answer to this above questions. Thanks in advance for your help.

      >>> You will not go out of status. However, you cannot work in the new role and location because USCIS rejected the amendment. If you cannot continue your work in the existing location on the existing role and get paid, then you will go out of status.

      >>> If you already have a valid H1B visa in the passport as of the date of your return, then you don't have to go for stamping again. You can use the existing H1B visa with the amended H1B petition to enter U.S.
