  • H1B Extension without travel to US

    Hi,

    I have a valid H1B Visa and it will be expired by 12th September' 2011. I have not yet traveled to US earlier.
    1). How can I extend my VISA without travel to US?
    2). Do I need to apply fresh Visa?

    please help me.

    You may use the same Visa and petition if the employer is still willing to employ you. However, since this is too close to expiry, the employer may not have sufficient time to file an extension in time after you travel to US, traveling so close to expiry may also raise questions at port of entry.
    You will need to find a job and the employer will file the petition for you. (either the same old petitioner or a new one). They can file a cap-exempt petition for you at any time using the cap from your previously approved petition. This means petition can be filed even after annual cap closes and with immediate start date as against Oct 1. After this is approved you can apply for your Visa again like before and travel to US to work.
