I have a query which I have not been able to find a query after lot of search and so request your assistance with clarification.
I changed my status from F-1 to H-1B in October 2008. I was laid off from the employer in December 2008 before I was able to get my visa stamped. I processed H-1B with another employer in February 2009. However, the new employer was not doing well and was not able to pay me and so I returned back to India in August 2009.
I have been based in India since 2009 and have been working here with a reputed IT company.
Now, there is another global company which may be interested in processing my H-1B visa in 2011. I have not been showing the employer who processed my H-1B in February 2009 in my resume since there was no value addition of experience from the employer.
Please suggest that if I was not paid a salary between Feb and August 2009 and that now I am based in India for past 2 years, Will I be able to get my new H-1B visa processed with another employer? Will I need to inform and send the new employer the I-797 of the second employer or I can simply use the I-797 from first employer or if there is any need to send I-797 at all? What documents would be needed in the H-1 stamping process and what are the chances of H-1 stamping success?
