  • Self-employed for a company in own country while on H1B in US?

So here is a scenario: Person is employed for a US company on an H1B visa. Gets paid, pays taxes, everything is legal, etc. Also the same person owns a company back in country of origin (at home).

Can person work for a random company in the US and then give an invoice issued by company that is registered in country of origin (at home)? Random company in US pays to the person and then person pays taxes at home since the invoice was made by the company at home. Person becomes kind of a clearinghouse for money that should go to the company at home.

Technically it seems legal. US company is paying to, lets say, German company for some work to be done. Work is done by a foreigner who lives in US and has H1B visa. Then worker pays taxes in Germany to be cool with German IRS, but keeps the profits in US as additional money.

I'm just wondering if that's legal at all?
