Query Regarding Non Competence

Hello Fellas & Experts,

I am working on the E-V-C model and my Employer asked me to sign a Non Competence agreement under which I would not be able to join the same client for atleast one year after I resign from my current company.

Now my client has liked my work and is willing to offer me Full Time.

Questions:

1) Does that Non Compete Agreement hold any value?
2) Is there a way to get out of that?
3) Can I tell (basically threaten) my Employer that if you dont let me go then I will resign? In that case he will not get anything, neither any commision from the Client for hiring me nor any monthly benefit / cut from my billing.

The client is a very good company and I dont really want to miss this opportunity.


Any help in this regards would be greatly appreciated.

Consult an attorney who has experience in both Labor and Immigration matters. Such agreements do hold and the employer can sue you for damages. Attorney can however find out if the employer has breached any term of the contract thereby rendering it void.
