  • H1B extension with revoked I-140 approval

    Hi All,

I need some clarifications from you regarding my H1B. I had a I-140 approval from my previous employer. When I do H1B transfer to my current emplyer (April, 2011), I thought, I could extend my H1B for 3 years based on the I-140 approval, but they gave me only 1 year (My 6 year is going to end April 2012). The reason the USCIS told us was, my previous employer revoked my I-140 approval just 10 days before my H1B approval date.

Now, I am getting some good opportunity from a company. I told them that I had a I-140 but they revoked the I-140 when I did a H1B transfer. The HR checked with Fragomen lawyers and told me that they can extend the H1B based on that approval.

I am kind of confusing.... Which one is true?. If Fragomen lawyers are correct, then why I didn't get my 3 year extension when I file for H1B transfer?

    Thanks
    Suri
