  • extension of I-94

    Hi,

I have query regarding my I-94.
    I have valid I-797 till 2013,
no visa stamping for this I-797,
    passport expiring in 2012,
I-94 was stamped till 2012(same as passport expiration date).
I will be applying for new passport in US.
Could you guide me how to get I-94 extended without leaving the country?
Would CBP extend my I-94 based on my I-797, if I visit with my new passport?

    Thank you.

First try visiting the nearby CBP post. They may or may not extend the I-94.
If that does not work your employer will have to file petition or petition amendment to get it extended.
Third option is of course to leave the US, get H1 Visa and return. When does/did your Visa expire?
This is my opinion and not legal advice.

I do not have visa stamping for present I-797 but I do have I-94(which expires in 2012). I traveled using my previous H1B visa and while entering showed my new I-797 and got the I-94 for the same. My Visa got expired and I do not have stamping for new I-797.

Where can I locate my nearest CBP office?

      Thank you.
